TERMS & CONDITIONS: HAND-PAINTED MURALS

These terms and conditions apply to the Service provided by The Dreaming Heart Art Studio (“the Studio," “we,” or “us”), which includes the Owner, Rosa Lee Poirier, and any helpers assisting with the Service.

We may amend any of our Terms & Conditions at any time, and without notice. The revised version will be posted on our website with the revision date and will be effective as of the time it is posted.​
​
If you ask us to schedule, reschedule, or cancel an appointment on your behalf (including applying or adjusting existing credit, if applicable), you are responsible for reviewing our most current Terms & Conditions before making the request. Your continued use of our Service constitutes acceptance of the most current Terms & Conditions.

Please read these Terms and Conditions carefully before reserving the Service and print off a copy for your records.

By reserving the Service, you agree to the terms of this agreement which will legally bind you.
​
1. DEFINITIONS
“Service” means the provision of a Hand-Painted Mural by the Studio.
​
"Hand-Painted Mural" means an original artwork hand-painted by the Studio onto any walls, furniture, or other interior or exterior surfaces at the Location (referred to in these Terms & Conditions as a "mural").
​
"Location" means the physical location where the Service is performed.
​
“Appointment” means the scheduled date and time reserved for the Service to be performed at the Location.
​​
“you” means the individual or organization reserving the Service(s), and includes any property owner or authorized representative granting permission for the work to be completed at the Location.
​
"Rose" means Rosa Lee Poirier, the Owner of the Dreaming Heart Art Studio.
​
“Fee” means the total amount payable by you to the Studio for the Service. Fees may include, but are not necessarily limited to, the Base Fee Deposit, Balance Owing, additional fees, Travel Fee, or Rescheduling Fee.

“Website” means https://www.thedreamingheartartstudio.com.
​
"Email" means dreamingheartart@gmail.com.
2. THE SERVICE
2.1. Service Description: A description of the Service is available on our website. We will provide the Service with reasonable care and skill in accordance with the description set out on the website.

2.2. Service Changes: We reserve the right to vary or withdraw the Service described on the website without notice including but not limited to fee adjustments.
3. FEES, REFUNDS, RESCHEDULES, & CANCELLATIONS
3.1 Base Fee Deposit: Once the Service is confirmed, you will receive a time-sensitive Appointment reservation link. The Base Fee Deposit must be paid within 48 hours to secure your Appointment.

3.2 Non-Refundable Policy: The Base Fee Deposit is non-refundable. If you cancel the Service, you will not be refunded the Base Fee Deposit. The Base Fee Deposit includes up to 12 square feet of coverage. If your mural is smaller, this space can be used to create a more detailed and refined design within this smaller area. For murals that use the full 12 square feet, designs are simpler and more open in composition. If the Studio cancels the Service, the Base Fee Deposit will be refunded in full.

3.3 Balance Owing: The Balance Owing, above and beyond the Base Fee Deposit, is due in full upon completion of the Service on the day of the Appointment. For a Service that extends beyond one day, payment is due at the end of each day based on the work completed to date.

3.4 Travel Fee: For Locations more than 30 km round-trip from Chesterville, Ontario, a Travel Fee of $0.90 + HST per additional kilometre applies.
​
3.5 Rescheduling Fee: Reschedule requests must be submitted at least 14 days before the original Appointment date to avoid a Rescheduling Fee. Requests made with less than 14 days' notice incur a non-refundable $50 + HST Rescheduling Fee.

4. CREATIVE FREEDOM
4.1 Creative Interpretation & Artistic Process: Due to the creative nature of a mural, the final artwork may vary from the original concept or expectations. You are encouraged to review Rose’s portfolio on the “Hand-Painted Murals” page to gain a clear understanding of her artistic style.
​
While your vision will always guide the design, each mural is interpreted through Rose’s unique style and approach, and may include intuitive, in-the-moment decisions as part of the creative process. By booking the Service, you acknowledge and agree to allow a reasonable level of artistic freedom.
​
You are welcome to check in throughout the painting process to view progress, ask questions, and share feedback.

5. SITE PREPARATION & ACCESS
5.1 Surface Preparation: You are responsible for ensuring that the mural surface is clean, dry, smooth, and suitable for painting. Surfaces should be properly prepared and primed if necessary. The Studio is not responsible for issues resulting from pre-existing surface conditions.
​
5.2 Work Area: The Studio will take reasonable care to protect surrounding areas using drop cloths and coverings. You are responsible for removing or protecting valuable or delicate items.
​
5.3 Accessibility: The work area must be safe, accessible, and free of obstacles. The Studio does not perform work at excessive heights and is limited to the use of a standard step ladder or ladder.

5.4 Access to the Location: You are responsible for providing access to the Location at the scheduled Appointment time. If you are not present, written arrangements must be made in advance for entry.
You remain responsible for the security of the Location at all times. If the Studio assists with locking or securing the property, this is done as a courtesy only.
The Studio is not liable for the security of the property or for any loss, damage, or unauthorized entry.

5.5 Environment & Disruptions: You are responsible for maintaining a safe and reasonably distraction-free environment. Children, pets, and others must be kept at a safe distance from the work area. The Studio may pause work if conditions are unsafe or significantly disruptive.

6. CARE, DURABILITY & NATURAL VARIATION
​
6.1 Mural Care & Longevity: Murals are original works of art and may include natural variation in texture, color, and finish. These qualities are part of the artistic process and are not considered defects.
The longevity of the mural depends on environmental conditions, surface quality, and general wear and tear. The Studio is not responsible for damage caused by moisture, sunlight, improper cleaning, surface deterioration, physical contact, or accidental damage.

You are responsible for the ongoing care and maintenance of the mural after completion.
7. APPROVAL & SATISFACTION

7.1 Approval & Satisfaction: You acknowledge that a mural is a custom, original work of art. While the Studio will make reasonable efforts to align the mural with the agreed concept and overall vision, artistic interpretation is inherent to the process.
​
You are encouraged to provide feedback during the painting process. Once the mural is completed, dissatisfaction based on personal preference or subjective taste will not be grounds for refund, revision, or removal.

Additional revisions requested after completion may be subject to additional fees.

8. PRIVACY POLICY

9. INDEMNITY CLAUSE
9.1 General Liability: The Studio shall not be held liable (jointly or severally) to you for personal injury, loss, or any incidental, indirect, or consequential damages of any kind, whether foreseeable or not, arising from or in connection with the Service.​
​
9.2 Property & Surface Liability: The Studio will take reasonable care while performing the Service; however, you acknowledge that painting a mural carries inherent risks. The Studio is not responsible for damage to surfaces or property resulting from pre-existing conditions, improper preparation, or factors outside of the Studio’s control.
​
9.3 Liability Cap: Under no circumstances shall the total liability of the Studio for any damages or losses arising from the Service exceed the total amount of the Service in which the claim arose.
