TERMS & CONDITIONS FOR PRIVATE ART PARTY BOOKING

 

These terms and conditions apply to Private Art Parties (for Kids & Teens) provided by The Dreaming Heart Art Studio and authorized staff (“the Studio” or “we” or “us”).

Please read these terms and conditions carefully before booking a Private Art Party and print off a copy for your records.

In booking a Private Art Party, you agree to the terms of this agreement which will legally bind you. 

1. DEFINITIONS

"Service” means the provision of any Private Art Party.

“Private Art Party" means a private art event taught by us in the Studio or at a public or private venue ("Party" or "Event").

“You” means the adult who is completing the online registration process.

“Participant(s)” means the minor child/children who will be attending the Private Art Party.

“Website” means https://www.thedreamingheartartstudio.com.

"Email" means info.dreamingheartart@gmail.com 

“Fees” means the fees paid by you to The Dreaming Heart Art Studio for the Service.

2. THE SERVICE

 

2.1. A description of our Service is available on our website.  We will provide the Service with reasonable care and skill in accordance with the description set out on the website.

2.2. We reserve the right to vary or withdraw this Service described on the website without notice, including but not limited to fee adjustments.

3. REGISTRATION, RESCHEDULING, & CANCELLATIONS 

3.1 We require that the Parents/Legal Guardians of each participant give consent for their child to attend your event by reviewing our Terms & Conditions and filling out our Participant Registration Form.  This registration information is available on our website ("Private Art Parties > Participant Registration").  When you book a Party, you will also receive a website link to this registration information via your booking confirmation email.  It is your responsibility to forward this link to the parents of your invitees and to ensure that each guest has been registered prior to your event. *Please fill out the form, as well, if you have a child attending.* 

 

3.2 The party fee is due in full upon registration.  It is your responsibility to collect payment from your guests, should you choose to do so.

3.3 If you would like to reschedule your party, please contact the Studio via email a minimum of 7 days (168 hours) prior to your event, and we will issue you a party rescheduling code.  This code can be used to register for a new party date.  Your party rescheduling code must be redeemed within 1 year of the code issue date.  If we receive notification of your rescheduling request less than 7 days (168 hours) before the event for which you are rescheduling, you will be charged a $50 fee in addition to the party fee, due at the time of rescheduling.

3.4 Cancellation requests received 7 days (168 hours) or more before your event will receive a partial refund (total party fee, less a $50 cancellation fee).  Notice must be given in writing via email.  Cancellation requests received less than 7 days (168 hours) before your event, will NOT be issued any refunds.  Your full payment will be forfeited. 
 

4. PARTY SCHEDULE

4.1 Parties include up to 1.5 hours of step-by-step instruction. Please be advised that we adhere strictly to the agreed-upon party start and finish time.  We will not extend the start or finish time of your party for tardy participants or for participants who have not completed their art pieces.

5. FOOD

 

5.1 We are a food-free studio.  Please do not bring food to your event.  Water in a sealed bottle only.

7. INDEMNITY CLAUSE

 

7.1 Neither the Studio, any of the art instructors, nor any of the assistants shall ever be held liable (jointly or severally) to you, the parents/legal guardians of the participant(s), the participant(s), or any of your respective estates or representatives, for personal injury or any incidental, indirect, or consequential damages of any kind, or any damages resulting from loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the Services.  Under no circumstance shall the total liability of the Studio, any of the art instructors, or any of the assistants for any damages or losses arising from the Services exceed the maximum amount of the price of the Services for which you paid.

In registering your child for a Private Art Party, you agree to the terms of this agreement which will legally bind you.

“Private Art Party" means a private art event taught by us in the Studio or at a public or private venue ("Party" or "Event").

“You” means the parent/legal guardian of the child who is attending a Private Art Party.

“Participant(s)” means the minor child/children who will be attending the Private Art Party ("student" or “child” or “children”).

2. THE SERVICE

3. DROP-OFF & PICK-UP

3.1 The Studio is not responsible for monitoring who drops off and picks up your child.  It is your responsibility to ensure the safe and timely drop-off and pick-up of your child.

3.2 At this time, we do not have a seating area for parents.  We ask that a maximum of 2 parents stay for the duration of the Party.

4. FOOD

 

4.1 We are a food-free studio.  Please do not send food with your child.  Water bottled only.  

5. ALLERGIES & MEDICAL

 

5.1 We strive to be allergy conscious and to provide a safe environment for participants; however, we do not guarantee a nut-free nor allergen-free Studio. 

5.2 You are responsible for indicating any allergies or other medical conditions of your child on our Participant Registration Form.  If there are any changes to your child's information, please promptly resubmit the Participant Registration Form or contact us via email with the updated information.

5.3 We require all children who are prescribed an epi-pen, inhaler, or diabetic monitor to carry it with them at all times while on the Studio premises, no exceptions.  

 

5.4 You assume all risk as it pertains to your child’s allergies and medical issues.

5.5 You expressly grant the Studio consent to seek emergency medical care for your child when the Studio is unable to contact you and when waiting for your consent would jeopardize the health and welfare of your child.

6. ILLNESS & SICK POLICY

 

6.1 You agree that you will not bring your child to a party if they are showing any signs of illness or if someone in your household has signs of illness.  We reserve the right to restrict admission or send a child home, when, in our opinion, that child is ill or risks the health or well-being of other participants. 

7. BEHAVIOUR

 

7.1 Any participant found to be disruptive may be dismissed from the party with no refund at the Studio’s sole and absolute discretion.  We have a no-tolerance policy for disrespectful behaviour.

8. CLOTHING

 

8.1 Making art can get super messy!  We do not provide smocks/aprons as they can get in the way of creating.  Children should wear old, comfy, art-friendly clothes which you do not mind them getting messy or permanently stained.  This includes art-friendly socks/indoor shoes, as children are asked to remove outdoor footwear upon entering the Studio.
