2. THE SERVICE
2.1. A description of the Service is available on our website. We will provide the Service with reasonable care and skill in accordance with the description set out on the website.
2.2. We reserve the right to vary or withdraw the Service described on the website without notice including but not limited to fee adjustments.
3. FEES, CANCELLATION, & RESCHEDULING
3.1 The base fee is *non-refundable and is due in full upon reservation in order to secure your art workshop date and time. If you choose to cancel the Service or if some/all of the participants do not attend the art workshop you will not be refunded the base fee.
(*The only exception when it comes to refunding the base fee is if the Studio cancels your Service, in which case you will be refunded the base fee in full).
3.2 The base fee includes up to 15 participants and up to 1.5 hours of step-by-step instruction. If you have fewer than 15 participants, you are still required to pay the base fee.
3.3 If you have more than 15 participants attending, additional fees will apply ($20/additional participant).
3.4 Depending on the venue location, an additional travel fee may apply. Said fee will be agreed upon prior to the Service being provided and will be included in the final invoice.
3.5 Any and all additional fees owing above and beyond the base fee; such as additional participant fees, travel fees, and/or Service add-ons (see Section 6.) will be invoiced on the day the Service is provided and will be due in full no later than 7 days after the Service has been provided.
3.6 In order to ensure quality instruction, the Service is capped at 30 participants.
3.7 We require your total participant number a minimum of 10 days before your Service date. This will ensure Ms. Rose is able to purchase adequate art materials! *Depending on Studio inventory, we can sometimes accommodate last-minute requests for additional participants. Please don't hesitate to ask!
3.8 If you need to reschedule your Service, please let us know a minimum of 14 days before your original Service date to avoid being charged a rescheduling fee. Rescheduling requests made with less than 14 days' notice will be charged a *non-refundable $50 rescheduling fee, due in full upon rescheduling.
4. ADULT PARTICIPATION & SUPERVISION FOR MINOR PARTICIPANTS (under 18 years of age)
4.1 "Art in the Classroom Workshops" are child-focused events (6+ yrs.). While not necessary, adults are welcome to paint alongside the children, however, they will be counted toward the participant total.
4.2 You must ensure there is at least one adult in attendance for the duration of the Service. This(These) individual(s) is(are) not required to participate but must be there at all times to provide supervision.
5. SET UP & TAKE-DOWN
5.1 The Studio does not provide tables or chairs. You are responsible for providing and setting up tables and chairs ahead of time. Please provide adequate table space for each participant to lay a 12" x 16" canvas in front of them (we do not use easels), a paint palette, brushes, and a water cup.
5.2 The Studio does not provide protective table coverings. While the paint we use is typically washable, it might permanently stain some surfaces. We highly recommend you protect your table(s) by using a disposable table covering(s).
5.3 The venue must be made available to the Studio one hour prior to the Service start time and half an hour after the Service end time, so as to enable the Studio to set up and take-down art materials.
6. MISSING/LATE PARTICIPANTS & SERVICE ADD-ONS
6.1 Ms. Rose will start instruction at the reserved time regardless of missing/late participants. Ms. Rose will do her best to bring late-arriving participants up to speed, however, please note that instructions for said participants will be condensed so as to fulfill overall instructions for the group within the reserved time period.
6.2 Please note, every artist creates at a unique pace and it is common for some participants to not finish their painting within 1.5 hours. If Ms. Rose's schedule permits, you are welcome to extend the Service hours to accommodate late finishers. Additional time is charged at $30/30-minute increment and will be included in the final invoice and due in full the day the Service is provided before Ms. Rose leaves the venue.
7.1 Please ensure participants wear art-friendly clothes as making art is messy and may result in permanent stains. We do not provide smocks/aprons.
9. INDEMNITY CLAUSE
9.1 Neither the Studio, any of the art instructors, nor any of the assistants shall ever be held liable (jointly or severally) to you, the participants, or any of your respective estates or representatives, for personal injury or any incidental, indirect, or consequential damages of any kind, or any damages resulting from loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the Service. Under no circumstance shall the total liability of the Studio, any of the art instructors, or any of the assistants for any damages or losses arising from the Service exceed the maximum amount of the price of the Service for which you paid.
