TERMS & CONDITIONS: ART IN THE CLASSROOM WORKSHOPS

These terms and conditions apply to the Service provided by The Dreaming Heart Art Studio and authorized staff (“the Studio” or “we” or “us”).  

We may amend any of our Terms & Conditions at any time, and without notice.  We will post the revised version on our website along with the revision date.  The revised version will be effective as of the time it is posted.​

Please read these terms and conditions carefully before reserving the Service and print off a copy for your records.

In reserving the Service, you agree to the terms of this agreement which will legally bind you. 

 

1. DEFINITIONS

“Service” means the provision of an "Art in the Classroom Workshop."

"Art in the Classroom Workshop" means an art workshop for elementary students that is taught by us at a venue (also referred to as an "art workshop" or "workshop").

"Venue" means the physical location (public or private), where the art class is taking place.

"Rose" means Rose Poirier, the owner and instructor of the Dreaming Heart Art Studio.

“You” means the individual/school/organization reserving the Service.​​

"Participant(s)" means the person(people) participating in the Service.  Participants must be 6+ years of age.

“Fee(s)” means the fee(s) paid by you to the Studio for the Service.

“Website” means https://www.thedreamingheartartstudio.com.

"Email" means dreamingheartart@gmail.com.

 

2. THE SERVICE

 

2.1. A description of the Service is available on our website.  We will provide the Service with reasonable care and skill in accordance with the description set out on the website.

2.2. We reserve the right to vary or withdraw the Service described on the website without notice including but not limited to fee adjustments.

3. FEES & RESCHEDULING

3.1 Payment for the Service is due in full the day the Service is provided.  Fees include the workshop fee (varies depending on quantity), art material fee ($7.50/participant + HST), and Service add-ons (if applicable; please see Section 4.).

 

3.2 Each workshop includes set-up, up to 1.5 hours of step-by-step instruction for up to 30 participants, and take-down.  If you have fewer than 30 participants, the workshop fee still applies.
 

3.3 We require your total participant number a minimum of 14 days before your Service date.  This will ensure Rose is able to purchase adequate art materials. Any leftover materials will remain the property of the Studio.

 

*Depending on Studio inventory, we can sometimes accommodate last-minute requests for additional participants.  Please don't hesitate to ask!

 

3.4 If you need to reschedule your Service, please let us know a minimum of 14 days before your original Service date to avoid being charged a rescheduling fee.  Rescheduling requests made with less than 14 days notice will be charged a *non-refundable $50 rescheduling fee + HST which will be included in the final invoice.

4. SERVICE ADD-ONS

 

4.1 Please note, every artist creates at a unique pace and it is common for some participants to not finish their painting within 1.5 hours.  If Rose's schedule permits, you are welcome to extend the Service hours to accommodate late finishers.  Additional time is charged at $50/30-minute increment + HST and will be included in the final invoice.

4.2 Depending on the venue location, a travel fee may apply.  Round trips that are 50 km or less from the Studio location do not incur a travel fee.  Round trips that exceed 50 km are charged at $1.20/km + HST above and beyond the initial 50 km.

5. SET UP & TAKE DOWN

5.1 The Studio does not provide tables nor chairs.  You are responsible for providing and setting up tables and chairs ahead of time.  If you have booked a painting workshop, please provide adequate table space for each participant to lay a 12" x 16" canvas in front of them (we do not use easels), a large paper plate, brushes, and a water cup.

 

5.2 The Studio does not provide protective table coverings.  While the paint we use is typically washable on hard surfaces, it might permanently stain some hard surfaces. We highly recommend you protect your table(s) by using a disposable table covering(s).  

 

5.3 The venue must be made available to the Studio up to an hour prior to the Service start time and up to an hour after the Service end time, so as to enable the Studio to set up and take down art materials.

 
 
6. CLASSROOM SUPERVISION

 

6.1 At least one staff member must be present at all times in order to provide classroom supervision.

7. LATE PARTICIPANTS

 

7.1 Rose will start instruction at the reserved time regardless of late participants.  Rose will do her best to bring late-arriving participants up to speed, however, please note that instructions for said participants will be condensed so as to fulfill overall instructions for the group within the reserved time period.
 

 

8.CLOTHING

 

8.1 Please ensure participants wear art-friendly clothes as making art is messy and may result in permanent stains.  We do not provide smocks/aprons.

9. PRIVACY POLICY

10. INDEMNITY CLAUSE

 

10.1 Neither the Studio, any of the art instructors, nor any of the assistants shall ever be held liable (jointly or severally) to you, the participants, or any of your respective estates or representatives, for personal injury or any incidental, indirect, or consequential damages of any kind, or any damages resulting from loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the Service.  Under no circumstance shall the total liability of the Studio, any of the art instructors, or any of the assistants for any damages or losses arising from the Service exceed the maximum amount of the price of the Service for which you paid.
