TERMS & CONDITIONS: PRIVATE ART PARTIES

These Terms and Conditions apply to the Service provided by The Dreaming Heart Art Studio (“the Studio,” “we,” or “us”), which includes the Owner, Rosa Lee Poirier, and any helpers assisting with the Service.
We may amend our Terms & Conditions from time to time. The revised version will be posted on our Website with the revision date and will be effective as of the time it is posted. Changes to the Terms & Conditions do not affect an existing confirmed reservation unless otherwise agreed upon or required by applicable law.
If you ask us to schedule, reschedule, or cancel your reservation on your behalf (including applying or adjusting existing art class credit, if applicable), you are responsible for reviewing our most current Terms & Conditions before making the request. Proceeding with a reservation or other request for the Service constitutes acceptance of the current Terms & Conditions.

Please read these Terms and Conditions carefully before reserving the Service and retain a copy for your records.
By reserving the Service, you agree to the terms of this agreement, which will legally bind you.
1. DEFINITIONS
“Service” means the provision of a Private Art Party by the Studio at a Venue.
“Private Art Party” means any private art event offered by the Studio and reserved by an individual or group. Examples include, but are not limited to, Private Paint Parties for Youth, Private Paint Parties for Adults, and Private Art Parties for Adults, including various workshop options offered by the Studio. In these Terms and Conditions, a Private Art Party is also referred to as an “Art Party” or “Party.” Reservation or attendance at a Private Art Party constitutes acceptance of these Terms and Conditions.
“Venue” means the physical location where the Private Art Party is taking place.
“You” means the person or organization who has reserved the Service.
“Participant” means any person who attends the Private Art Party, including, but not limited to, the person who reserved the Private Art Party.
“Minor Participant” means a Participant who is under the age of 18.
“Host” means the person or organization who reserves the Service or, where applicable, the person designated by the person who reserved the Service to organize or host the Private Art Party.
“Supervising Adult” means any adult responsible for supervising a Minor Participant during the Service, including an adult attending a Private Art Party with the Minor Participant or any adult designated by the Host or the Minor Participant’s parent or legal guardian to supervise the Minor Participant. The Supervising Adult assumes responsibility for the Minor Participant’s supervision, conduct, safety, and compliance with these Terms and Conditions.
“Fee” means the total amount payable by You to the Studio for the Service. Fees may include, but are not necessarily limited to, the Base Fee Deposit, Additional Participant Fee, Add-On Fee, Travel Fee, or Rescheduling Fee. Fees do not include Third-Party Services provided by the Venue or another third party.
“Third-Party Services” means goods or services provided by the Venue or another third party in connection with the Private Art Party, including, but not limited to, food and beverage services.
“Website” means https://www.thedreamingheartartstudio.com.
“Email” means dreamingheartart@gmail.com.
2. THE SERVICE
2.1 Service Description: A description of the Service is available on our Website. We will provide the Service with reasonable care and skill in accordance with the description set out on the Website.
2.2 Service Changes: We reserve the right to vary or withdraw the Service described on the Website without notice, including but not limited to fee adjustments. Changes to the Website do not affect an existing confirmed reservation unless otherwise agreed upon or required by applicable law.
3. FEES & REFUND/CANCELLATION POLICY
3.1 Base Fee Deposit: Once the Private Art Party date and time are confirmed, you will receive a time-sensitive reservation link. The Base Fee Deposit must be paid within 48 hours to secure the date and time. If payment is not made within this timeframe, the reserved date and time will be released.
3.2 Non-Refundable Policy: The Base Fee Deposit is non-refundable. If you cancel the Service or if some or all Participants do not attend, the Base Fee Deposit will not be refunded. The Base Fee Deposit includes payment for up to 6 Participants and applies regardless of the number of Participants who attend. If the Studio cancels the Service, the Base Fee Deposit will be refunded in full.
3.3 Additional Participant Fee: Participants above the 6 included in the Base Fee Deposit incur an Additional Participant Fee, which is due at least two weeks before the Service. Last-minute additions may be accommodated depending on the Studio’s inventory.
3.4 Add-On Fees: Certain canvas designs, workshop options, or customized party preferences may require additional time or materials.

Materials Add-On Fee: Some designs include larger canvases and/or mixed media materials and may include an additional fee per Participant, as specified on the applicable Canvas Gallery page on the Website.

Extended Time Add-On Fee: Art Parties include up to 1.5 hours of instruction for youth and up to 2.5 hours of instruction for adults. Additional time may be added in advance, depending on the needs of the group or selected design, as specified on the applicable Canvas Gallery page on the Website.
All applicable Add-On Fees will be clearly communicated prior to booking. Add-On Fees included in the reservation total are due at the time of booking unless otherwise specified.
3.5 Travel Fee: For Venues more than 30 km round-trip from Chesterville, Ontario, a Travel Fee of $0.70 per additional kilometre applies. Travel Fees included in the reservation total are due at the time of booking unless otherwise specified.
3.6 Rescheduling Fee: Rescheduling requests must be submitted at least 14 days before the original Service date to avoid a Rescheduling Fee. Requests made with less than 14 days’ notice may incur a non-refundable Rescheduling Fee of $50 + HST.
4. SUPERVISION FOR MINOR PARTICIPANTS
4.1 Private Art Parties for Youth: A Supervising Adult must remain on-site for the entire Service to supervise Minor Participants. The Studio does not provide childcare or general supervision of Minor Participants.
4.2 Minors at Private Art Parties for Adults: Private Art Parties for Adults are intended for Participants aged 18 and over. If a Minor Participant attends a Private Art Party for Adults, they must be accompanied by a Supervising Adult.
4.3 Supervising Adult Responsibilities: The Supervising Adult is responsible for each Minor Participant’s supervision, conduct, safety, and compliance with these Terms and Conditions during the Service. The Host or the Minor Participant’s parent or legal guardian is responsible for ensuring that an appropriate Supervising Adult is designated for each Minor Participant. The Studio may rely on the Host’s or the Minor Participant’s parent or legal guardian’s designation of a Supervising Adult and is not responsible for verifying the Supervising Adult’s authority or for obtaining or verifying parental or guardian consent for a Minor Participant’s attendance or supervision arrangements.
4.4 Parental/Guardian Permission: The person who reserves the Service is responsible for communicating these supervision requirements to the parents or legal guardians of Minor Participants, where applicable. The Studio does not require individual parental or guardian permission forms unless otherwise specified by the Studio. Parents and legal guardians remain responsible for determining whether their Minor Participant is permitted to attend the Art Party and for communicating any relevant instructions or restrictions to the Host and Supervising Adult.
5. ALLERGENS
5.1 Allergy Awareness: The Studio does not guarantee an allergen-free environment.
5.2 Possible Allergen Exposure: Materials used during Art Parties are prepared in a home studio where common allergens, including food allergens, may be present. Some materials may include items that have been reused or repurposed from previous Art Classes or Art Parties, or that incorporate food-related craft items (e.g., dried pasta) or food containers (e.g., washed yogurt containers), which may have involved exposure to allergens, including food allergens. All materials are checked to ensure they are in good condition; however, the Studio does not guarantee that any material or item is free from allergens.
5.3 Food & Cross-Contamination: Food and beverages may be sold at the Venue and may contain or have come into contact with food allergens. The Studio does not prepare, sell, monitor, or control food or beverages provided or sold by the Venue or other third parties. Participants are responsible for determining whether food or beverages are suitable for their individual needs. The Studio is not responsible for allergic reactions or other effects arising from food or beverages provided or sold by the Venue or other third parties. The Studio is also not responsible for cross-contact or cross-contamination involving food, art materials, shared surfaces, or personal belongings during the Art Party, except where responsibility cannot lawfully be excluded or limited.
5.4 Participant/Supervising Adult Responsibility: Adult Participants are responsible for their own safety regarding food allergies or sensitivities. Supervising Adults are responsible for supervising Minor Participants and ensuring their safety regarding food allergies or sensitivities. By attending the Art Party, all Participants and Supervising Adults acknowledge that allergens may be present.
6. VENUE
6.1 Third-Party Services: Art Parties may take place at Venues that provide Third-Party Services, including, but not limited to, food and beverage services. The Studio is not responsible for services provided by third parties, except where responsibility cannot lawfully be excluded or limited.
6.2 Third-Party Service Charges: You are responsible for any additional charges you incur at an Art Party, including, but not limited to, food and beverage purchases.
6.3 Venue Conditions: Art Parties may take place in a variety of Third-Party Venues, including public or shared spaces. The Studio does not control the conditions of these Venues and is not responsible for hazards, conditions, or circumstances arising from the Venue environment, including, but not limited to, equipment, weather in the case of outdoor events, or the actions of other Venue guests or staff, except where responsibility cannot lawfully be excluded or limited.
6.4 Set-Up & Take-Down: You are responsible for arranging and coordinating the Venue, including ensuring that suitable tables and chairs are available and set up before the Service. The Venue must be made available at least 1 hour before and 1 hour after the Service to allow the Studio to set up and take down materials. The Studio is not responsible for arranging Venue access, tables, chairs, or other Venue facilities unless otherwise agreed in writing.
6.5 Indoor/Water Access: Art Parties must take place indoors unless otherwise agreed, with access to running water.
7. LATE PARTICIPANTS
7.1 Start Time: The Studio will begin instruction at the reserved time regardless of missing or late Participants.
8. PROTECTING FURNITURE & CLOTHING
8.1 Messy Materials: Participants should wear comfortable, art-friendly clothing that they do not mind getting permanently stained. Aprons are not provided. Tables should be covered with protective coverings, which are not provided by the Studio.
9. PRIVACY POLICY
9.1 Privacy Policy: Please read our Privacy Policy on our Website.
10. LIABILITY & INDEMNITY
10.1 General Liability: The Studio is not responsible for personal injury, loss, or incidental, indirect, or consequential damages arising out of or in connection with participation in the Service, except where such liability cannot lawfully be excluded or limited.
10.2 Participant Responsibility: Each Adult Participant is responsible for their own conduct, participation, and personal belongings during the Service and for complying with these Terms and Conditions. Each Supervising Adult is responsible for the supervision, conduct, safety, and compliance with these Terms and Conditions of any Minor Participant under their supervision.
10.3 Indemnity: Each Adult Participant and each Supervising Adult agrees to indemnify and hold harmless the Studio from claims, damages, losses, or expenses arising from their own acts, omissions, or failure to comply with these Terms and Conditions, except where such liability cannot lawfully be excluded or limited.
10.4 Personal Items: Participants are responsible for their personal belongings. The Studio is not responsible for loss, theft, or damage to personal items brought to or left at the Art Party, except where such liability cannot lawfully be excluded or limited.
10.5 Applicable Law: Nothing in these Terms and Conditions limits or excludes any rights, remedies, warranties, or liability that cannot lawfully be limited or excluded.
