TERMS & CONDITIONS: PRIVATE ART PARTIES

These Terms and Conditions apply to the Service provided by The Dreaming Heart Art Studio (“the Studio,” “we,” or “us”), which includes the Owner, Rosa Lee Poirier, and any helpers assisting with the Service.

We may amend any of our Terms & Conditions at any time, and without notice. The revised version will be posted on our website with the revision date and will be effective as of the time it is posted.
​
If you ask us to schedule, reschedule, or cancel your registration on your behalf (including applying or adjusting existing art class credit, if applicable), you are responsible for reviewing our most current Terms & Conditions before making the request. Your continued use of our services constitutes acceptance of the current Terms & Conditions.

Please read these Terms and Conditions carefully before reserving the Service and print off a copy for your records.

By reserving the Service, you agree to the terms of this agreement which will legally bind you.

1. DEFINITIONS
​
“Service” means the provision of a Private Art Party offered by the Studio at any venue.
​​
“Private Art Party” is any Private Art Party offered by the Studio, reserved for yourself, on behalf of someone else, or for a group of Participants (referred to in these Terms and Conditions as an “Art Party” or “Party”). Examples include, but are not limited to, Private Paint Parties for Adults, Private Paint Parties for Youth, and Soul Sisters Art Workshops. Reservation or attendance in any Private Art Party constitutes acceptance of these Terms and Conditions.

“Venue” means the physical location where the Private Art Party is taking place.​
​
“you” means the person or organization who has reserved the Service and includes any person who attends the Private Art Party.
​
“Participant” means any person who attends the Private Art Party, including, but not limited to, the person or organization who reserved the Private Art Party.
​
“Minor(s)” means a Participant(s) who is (are) under the age of 18.
​
“Supervising Adult” means any adult responsible for supervising a Minor Participant during the Service, including the adult attending the Private Art Party with the minor or any adult designated by the host or parent/guardian to supervise the minor. The Supervising Adult assumes responsibility for the Minor Participant’s supervision, conduct, safety, and compliance with these Terms & Conditions.

“Fee” means the total amount payable by you to the Studio for the Service. Fees may include, but are not necessarily limited to, the Base Fee Deposit, Additional Participant Fee, Add-On Fee, Travel Fee, or Rescheduling Fee. Fees do not include any potential Third-Party Services provided by the Venue.​

2. THE SERVICE
​
2.1 Service Description: A description of the Service is available on our website. We will provide the Service with reasonable care and skill in accordance with the description set out on the website.
​
2.2 Service Changes: We reserve the right to vary or withdraw the Service described on the website without notice, including but not limited to fee adjustments.
​
3. FEES & REFUND/CANCELLATION POLICY
​
3.1 Base Fee Deposit: Once your Art Party date is confirmed, you will receive a time-sensitive reservation link. The Base Fee Deposit must be paid within 48 hours to secure your date and time. If payment is not made within this timeframe, your reserved date will be released.
​
3.2 Non-Refundable Policy: The Base Fee Deposit is non-refundable. If you cancel the Service or if some/all participants do not attend, you will not be refunded the Base Fee Deposit. The Base Fee Deposit includes payment for up to 6 participants and it applies regardless of whether the minimum Participant count is met. If the Studio cancels the Service, the Base Fee Deposit will be refunded in full.

3.3 Additional Participant Fee: Participants above the 6 included in the Base Fee Deposit incur an Additional Participant Fee, due at least two weeks before the Service. Last-minute additions may be accommodated depending on Studio inventory.

3.4 Add-On Fees: Certain canvas designs and party preferences may require additional time or materials.
​

Materials Add-On Fee – Some designs include larger canvases and/or mixed media materials and may include a materials add-on fee per participant.

Extended Time Add-On Fee – Paint parties include up to 1.5 hours of instruction for youth and up to 2.5 hours of instruction for adults. Additional time may be added in advance, depending on the needs of the group or selected design.

All applicable add-on fees will be clearly communicated prior to booking. Add-on fees included in the reservation total are due at the time of booking unless otherwise specified.
​
3.5 Travel Fee: For Venues more than 30 km round-trip from Chesterville, Ontario, a Travel Fee per additional kilometre applies.
​
3.6 Rescheduling Fee: Reschedule requests must be submitted at least 14 days before the original date to avoid a Rescheduling Fee. Requests made with less than 14 days’ notice may incur a non-refundable Rescheduling Fee.

4. SUPERVISION FOR MINORS
​
4.1 Youth Art Parties: For Art Parties for Youth, the Supervising Adult (either the hosting adult or another designated adult) must remain on-site for the entire Service to supervise Minors.
4.2 Minors at Adult Art Parties: Private Art Parties designated as adult-only are intended for participants aged 18 and over. If a Minor attends an Adult Art party, they must be accompanied by a Supervising Adult.

4.3 Supervising Adult Responsibilities: The Supervising Adult is responsible for each Minor Participant’s supervision, conduct, safety, and compliance with these Terms and Conditions. The Supervising Adult represents and warrants that they have permission from each Minor Participant’s parent or legal guardian for the Minor to attend the Art Party and for the Supervising Adult to agree to these Terms and Conditions on the Minor’s behalf. The Studio is not responsible for verifying such permission.

5. ALLERGENS
​
5.1 Allergy Awareness: We do not guarantee an allergen-free environment.
​
5.2 Possible Allergen Exposure: Materials used during Art Parties are prepared in a home studio where common allergens, including food allergens, may be present. Some materials may include items that have been reused or repurposed from previous Art Classes or Art Parties, or that incorporate craft-related food items or food containers, which may have involved exposure to allergens, including food allergens. All materials are checked to ensure they are in good condition; however, the Studio does not guarantee that any material or item is free from allergens.

5.3 Food & Cross-Contamination: Food and beverages may be sold at the Venue. Such food and beverages may contain or have come into contact with food allergens. The Studio does not monitor or control the food and beverages purchased or consumed by Participants and disclaims all responsibility for any allergic reactions or related effects. The Studio further disclaims any liability for cross-contact or cross-contamination that may occur between food, art materials, shared surfaces, or personal belongings during the Art Party.

5.4 Participant/Accompanying Adult Responsibility: Adult participants are responsible for their own safety regarding food allergies or sensitivities. Accompanying Adults are responsible for supervising Minors and ensuring their safety regarding food allergies or sensitivities. By attending, all Participants, and Supervising Adults, acknowledge that allergens may be present.

6. VENUE
​
6.1 Third-Party Services: Art Parties may take place at Venues that provide Third-Party-Services, including, but not limited to, food and beverage service. The Studio is not responsible for any services provided by these third parties.

6.2 Third-Party Service Charges: You are responsible for any additional charges you incur at an Art Party, including, but not limited to, food and beverage purchases.
​
6.3 Venue Conditions: Art Parties may take place in a variety of Third-Party Venues, including public or shared spaces. The Studio does not control the conditions of these Venues and is not responsible for hazards, conditions, or circumstances arising from the Venue environment, including, but not limited to, equipment, weather (for outdoor events), or the actions of other Venue guests or staff.

6.4 Set-Up & Take-Down: You are responsible for providing and setting up tables and chairs ahead of time. The Venue must be made available at least 1 hour before and 1 hour after the Service to allow the Studio to set up and take down materials.

6.5 Indoor/Water Access: Art Parties must take place indoors unless otherwise agreed, with access to running water.

7. LATE PARTICIPANTS​​
​
7.1 Start Time: The Studio will begin instruction at the reserved time regardless of missing or late participants.
​
​
8. PROTECTING FURNITURE & CLOTHING
​
8.1 Messy Materials: Participants should wear comfortable, art-friendly clothes which they do not mind getting permanently stained. Aprons are not provided. Tables should be covered with protective coverings (not provided).​

10. INDEMNITY CLAUSE
​
10.1 General Liability: The Studio shall not be held liable (jointly or severally) for personal injury, loss, or incidental, indirect, or consequential damages arising out of or in connection with participation in the Service, except as required by law.
10.2 Minor and Adult Participants: Each Adult Participant is responsible for their own attendance and participation and agrees to indemnify and hold harmless the Studio from any claims, damages, or losses arising therefrom. The Supervising Adult is responsible for the attendance and participation of any Minor Participant under their supervision and agrees to indemnify and hold harmless the Studio from any claims, damages, or losses arising therefrom.
10.3 Personal Items: Participants are responsible for their personal belongings. The Studio is not responsible for loss, theft, or damage to any personal items.
10.4 Liability Cap: Under no circumstances shall the total liability of the Studio for any damages or losses exceed the total amount of the Fee(s) paid for the specific Art Party.
