TERMS & CONDITIONS: ART CLASSES for ADULTS

We may amend any of our Terms & Conditions at any time, and without notice.  We will post the revised version on our website along with the revision date.  The revised version will be effective as of the time it is posted.​

If at any time you ask us to schedule, reschedule, or cancel your registration on your behalf (including applying or adjusting your existing credit, if applicable), you are fully responsible for reviewing our most current Terms & Conditions prior to making such a request and your continued use of our Service constitutes your acceptance of our most current Terms & Conditions.

Please read these terms and conditions carefully before reserving the Service and print off a copy for your records.

In registering for the Service, you agree to the terms of this agreement which will legally bind you.

1. DEFINITIONS

 

“Service” means the provision of any art class for adults at any venue.

​

"Art Class for Adults" means the art class for which you purchased a ticket, either for yourself or on behalf of someone else (defined in these Terms and Conditions as an "art class") and refers to, but may not be limited to: Paint Nights, Paint Days, Intuitive Paint Nights, Intuitive Paint Days, and Art Workshops.  Your attendance at any art class subjects you to these Terms and Conditions.

"Venue" means the physical location where the art class is taking place.

​

“You" or "Your" means and refers to the person(s) who purchased the ticket, and includes any person(s) that ends up using the ticket to attend the art class (defined in these Terms and Conditions as a "Participant(s)."

​

“Ticket Fee(s)” means the ticket fee(s) paid by you to The Dreaming Heart Art Studio for the Service(s).  The Ticket Fee(s) only covers the Service, and does(do) NOT include any potential third-party-services ("TPS") provided by the venue.  Please see section 5 for more details.

​

"Art class credit" means credit issued for a missed or cancelled art class (see section 3 for more details), or as part of a discount/special/contest prize.

“Website” means https://www.thedreamingheartartstudio.com.

​

"Email" means dreamingheartart@gmail.com.

 


2. THE SERVICE

 

2.1. A description of the Service is available on our website.  We will provide the Service with reasonable care and skill in accordance with the description set out on the website.

2.2. We reserve the right to vary or withdraw the Service described on the website without notice including but not limited to fee adjustments.

​3. REGISTRATION & REFUND/CANCELLATION POLICY

 

3.1 Seats are capped at a certain number and so pre-registration is always required.  No drop-ins, please. Ticket Fees are *NON-REFUNDABLE and must be paid in full upon registration.  Refunds will NOT be issued for non-attendance (including non-attendance due to illness) nor for late arrivals.

*If the Studio cancels an art class you will be issued a full refund.

​

3.2 If you are unable to attend your art class you are welcome to gift your ticket(s) to someone else. You are welcome to request art class credit (valued at the same cost as the missed art class) so long as you provide a minimum of 14 day's notice via email.  Art class credit will NOT be issued when less than 14 day's notice is given.

​

3.3 Art class credit issued by the Studio for a missed or cancelled art class, or as part of a discount/special/contest prize, expires one year from the issue date unless otherwise specified.  Art class credit can be applied towards any currently available art class. Art class credit cannot be applied to Private Art Parties or Studio merchandise.

4. PARTICIPANT AGE

​

4.1 These events are intended for adults and instruction is geared towards adults.  Teens 15+ yrs. are welcome to attend with a participating adult. Each participant is required to purchase a ticket.

5. VENUE

 

​5.1 At an art class you may encounter third-party services ("TPS"), including, but not limited to food and beverage service from the venue where the art class will take place.  The Studio is not responsible for the TPS provided to you by the venue where the art class will take place.  

 

5.2 You understand that you are responsible for all additional charges you incur at an art class, including, but not limited to food and beverage charges.​​​

 


6. BEHAVIOUR

 

6.1 Any Participant found to be rude or disruptive may be dismissed from the art class with no refund at the Studio’s sole and absolute discretion.  We have a no-tolerance policy for disrespectful and disruptive behaviour.

7. CLOTHING & ART MATERIALS 

 

7.1 Making art can get super messy!  We do not provide smocks/aprons as they can get in the way of creating.  Participants should wear comfy, art-friendly clothes which they do not mind getting messy or permanently stained.  All other art materials will be provided.

9. INDEMNITY CLAUSE

 

9.1 Neither the Studio, any of the art instructors, nor any of the assistants shall ever be held liable (jointly or severally) to you, or any of your respective estates or representatives, or any participant, for personal injury or any incidental, indirect, or consequential damages of any kind, or any damages resulting from loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the Service.  Under no circumstance shall the total liability of the Studio, any of the art instructors, or any of the assistants for any damages or losses arising from the Service exceed the maximum amount of the price of the Service for which you paid.
