TERMS & CONDITIONS: TAKE-HOME ART KITS

These Terms and Conditions apply to the Service provided by The Dreaming Heart Art Studio (“the Studio,” “we,” or “us”), which includes the Owner, Rosa Lee Poirier, and any helpers assisting with the Service.
We may amend any of our Terms & Conditions at any time, without notice. The revised version will be posted on our Website along with the revision date and will be effective as of the time it is posted.

Please read these Terms and Conditions carefully before placing your order or using your Art Kit.
By placing an order for an Art Kit, you agree to the terms of this agreement, which will legally bind you.
1. DEFINITIONS
“Service” means the provision of Take-Home Art Kits by the Studio.
“Take-Home Art Kit(s)” means any art kit(s) for which you place an order (referred to in these Terms and Conditions as “Art Kit(s)”) and includes any art kit created by the Studio, including, but not limited to, paint kits, collage kits, or other creative kits, whether described as “Take-Home,” “Kit,” or otherwise.
“you” means the individual placing the order for the Art Kit.
“Participant(s)” means any person using the Art Kit.
“Minor(s)” means a Participant under the age of 18.
“Fee” means the total amount payable by you to the Studio for the Art Kit, including the purchase price of the Art Kit and any applicable additional charges, such as a Deposit Fee or Delivery Fee.
“Website” means https://www.thedreamingheartartstudio.com.
“Email” means dreamingheartart@gmail.com.
2. SERVICE DESCRIPTION
2.1 Art Kit Description: A description of the Art Kit is provided on the Website. The Studio will provide the Art Kit with reasonable care and skill in accordance with the description.
2.2 Service Changes: The Studio reserves the right to vary or withdraw the Art Kit described on the Website without notice, including changes to contents, materials, or pricing.
2.3 Use of Materials: Use of the materials and contents included in the Art Kit is subject to the Studio’s Usage & Terms provided with the Art Kit. By purchasing and/or using an Art Kit, you agree to comply with these terms.
All original designs, artwork, instructions, and curated content included in the Art Kits are owned by, or used under license or permission by, The Studio and are provided for personal use only unless otherwise expressly stated.
You may not resell, share, or distribute the Studio’s designs, artwork, instructions, or curated content in whole or in part, whether in their original or altered form.
You may not use the Studio’s designs, artwork, instructions, or curated content as standalone elements for commercial purposes, claim them as your own, or reproduce, replicate, or create and sell Art Kits or similar products based on the designs, contents, or concept of the Art Kits.
Certain materials included in the Art Kits may be subject to third-party licensing or usage restrictions. The inclusion of such materials does not grant any rights beyond personal use. You are responsible for ensuring that any additional permissions required for commercial use are obtained.
3. SAFETY WARNINGS
3.1 Choking Hazard: Some Art Kits contain small parts. Not suitable for children under 3. Adult supervision recommended.
3.2 Allergen & Material Notice: Art Kits are prepared and packaged in a home where common allergens, including food allergens, may be present.
3.3 Participant Responsibility: All Participants, or adults supervising Minor Participants, are responsible for determining whether the Art Kit and its materials are suitable for their needs, including any allergies or sensitivities.
3.4 Staining Risk: Paints and other materials may stain clothing, furniture, or surfaces. Wear art-friendly clothing and protect work surfaces during use.
4. CREATIVE MATERIALS & VARIATION
4.1 Materials and Sourcing: The Studio carefully selects the materials included in each Art Kit to ensure a consistent creative experience and quality standard. Brand names and manufacturers of certain supplies and tools (including, but not limited to, canvas, brushes, paint, glue, markers, and other accessories) may vary from kit to kit based on availability, supplier inventory, and sourcing considerations. Regardless of any brand substitutions, the Studio will provide materials that are reasonably comparable in quality and suitable for the intended Art Kit project.
5. RECOMMENDED AGE & SUPERVISION
5.1 Recommended Age & Supervision: Art Kits are primarily designed with teens and adults in mind, but some kits (i.e., Paint Night Kits) may be suitable for children 6+ years, depending on the kit's complexity. Younger children may need adult assistance.
5.2 Supervising Adult Responsibility: Adults are responsible for supervising Minor Participants and ensuring the safe and appropriate use of the Art Kit and its materials. The Studio is not responsible for any injuries, damages, or losses related to the use of the kit or the failure to adequately supervise.
6. ORDERING & PAYMENT
6.1 Placing Your Order: To place an order please contact the Studio at dreamingheartart@gmail.com.
6.2 Payment: Full payment for the Art Kit order is required before the Studio begins preparing the order.
6.3 Processing Time: Art Kit orders are typically processed within 1–2 weeks, depending on stock and availability.
6.4 Pick-up & Shipping: Art Kit orders may be picked up from the Chesterville, Ontario Studio by appointment only. Shipping is available within Canada. Shipping fees are calculated based on the destination and the size and weight of the order. The applicable shipping fee will be provided to the purchaser and must be approved and paid before the Art Kit order is shipped.
The Studio is not responsible for delays, loss, or damage caused by third-party shipping carriers once an order has been shipped.
7. REFUNDS & EXCHANGES
7.1 All Sales Final: All sales are final. No refunds or exchanges will be issued except in the event of a defective product or where required under applicable law.
8. LIABILITY & INDEMNITY
8.1 General Liability: The Studio shall not be held liable (jointly or severally) to you, any Minor or Adult Participant, or any adult supervising a Minor, for personal injury, loss, or any incidental, indirect, or consequential damages arising from the use of the Art Kit.
8.2 Participant Responsibility: All participants are responsible for using the Art Kit safely. For Minor Participants, the adult supervising them assumes responsibility for the Minor’s safety and actions while using the Art Kit.
8.3 Liability Cap: Under no circumstances shall the total liability of the Studio for any claim arising from the use of an Art Kit exceed the total amount paid for that specific Art Kit.
