3. SAFETY WARNINGS

3.1 Choking Hazard: Some Art Kits may contain small parts and components that could break. Keep out of reach of children under 3 years of age.

3.2 Allergen & Material Notice: Art Kits are prepared in a home studio where common allergens, including food allergens, may be present. Some Art Kits include materials that have been reused or repurposed from previous Art Classes, which may have included exposure to allergens, including food allergens. All items are checked to ensure they are in good condition; however, we cannot guarantee that any item is free from allergens.

3.3 Participant Responsibility: All Participants, or adults supervising Minor Participants, are responsible for determining whether the Art Kit and its materials are suitable for their needs, including any allergies or sensitivities.

3.4 Staining Risk: Paints and other materials may stain clothing, furniture, or surfaces. Wear art-friendly clothing and protect work surfaces during use.

4. CREATIVE MATERIALS & VARIATION

4.1 Materials and Sourcing: As part of the Studio’s commitment to creativity and sustainability, each Art Kit is thoughtfully assembled using a combination of new materials, along with licensed and repurposed elements where applicable.

This means no two Art Kits are exactly the same. Specific materials, decorative elements, and even certain tools (such as brushes, glue, and markers) may vary depending on availability and the Studio’s creative process.

Regardless of these variations, each Art Kit is assembled to ensure a consistent level of quality and an appropriate quantity of materials for that Art Kit type.

5. RECOMMENDED AGE & SUPERVISION

5.1 Recommended Age & Supervision: Art Kits are generally better suited for tweens, teens, and adults. Younger Participants (approximately ages 6–8) may take part with adult supervision and assistance (they may need help following the instructions, or they may choose to create in their own one-of-a-kind way!).

Some Art Kits, particularly those involving more detailed or abstract creative processes (such as collage-based kits), are intended for teens and adults, with a primary focus on adult Participants.

5.2 Supervising Adult Responsibility: Any adult supervising a Minor Participant is responsible for ensuring the safe and appropriate use of the Art Kit and its materials. The Studio is not responsible for the supervision of Minor Participants or for any injuries, damages, or losses arising from a failure to adequately supervise.

6. ORDERING & PAYMENT
6.1 Placing Your Order: Art Kit orders are typically ready within 1–2 weeks, depending on stock and availability. Upon receiving your Art Kit order request, the Studio will contact you to confirm your order details and arrange payment.

6.2 Deposit Fee: A non-refundable Deposit Fee of 25% of the total Art Kit order is required to confirm your order. If the Studio is unable to fulfill your Art Kit order, the Deposit Fee will be refunded.

6.3 Pick-up & Delivery: Art Kit orders can be picked up at the Chesterville Studio by appointment. Delivery may be available for locations within 60 km (one-way) of the studio, depending on our availability. A flat rate Delivery Fee of $15 + HST applies.

6.4 Payment: The remaining balance owing is due at the time of pick-up. For delivered Art Kit orders, full payment must be received before the Art Kit order is dropped off.
6.5 Unattended Deliveries: If you request delivery without anyone present, it is your responsibility to designate a safe location for the Art Kit order. The Studio is not liable for loss, theft, or damage once the Art Kit order has been delivered and a delivery photo has been provided via email.

7. REFUNDS & EXCHANGES

7.1 All Sales Final: All sales are final. No refunds or exchanges will be issued except in the event of a defective product or where required under applicable law.

8. LIABILITY & INDEMNITY

8.1 General Liability: The Studio shall not be held liable (jointly or severally) to you, any Minor or Adult Participant, or any adult supervising a Minor, for personal injury, loss, or any incidental, indirect, or consequential damages arising from the use of the Art Kit.

8.2 Participant Responsibility: All participants are responsible for using the Art Kit safely. For Minor Participants, the adult supervising them assumes responsibility for the Minor’s safety and actions while using the Art Kit.
