TERMS & CONDITIONS: PRIVATE ART PARTIES

These terms and conditions apply to the Service provided by The Dreaming Heart Art Studio and authorized staff (“the Studio” or “we” or “us”).  

​

We may amend any of our Terms & Conditions at any time, and without notice.  We will post the revised version on our website along with the revision date.  The revised version will be effective as of the time it is posted.​

Please read these terms and conditions carefully before reserving the Service and print off a copy for your records.

​

In reserving the Service, you agree to the terms of this agreement which will legally bind you. 

​

 

1. DEFINITIONS

​​​

“Service” means the provision of a "Private Art Party." 

​

"Private Art Party" means a private art party that is taught by us at the Studio location, or a public or private venue (also referred to as a "art party" or "party").

​

"Studio location" means Kemptville Education & Community Centre, Room 110 on the 2nd Floor of Parish Hall, 40 Campus Dr, Kemptville, ON K0G 1J0, Canada.

​

"Venue" means the physical location (public or private) for out-of-Studio art parties.

​

"Rose" means Rose Poirier, the owner and instructor of the Dreaming Heart Art Studio.

​

“You” means the individual/organization reserving the Service.​​

​

"Participant(s)" means the person(people) participating in the Service.  Participants must be 6+ years of age.

​

“Fee(s)” means the fee(s) paid by you to the Studio for the Service.

​

"Base fee" means the non-refundable deposit paid by you to the Studio to secure your Service date and time. 

​

“Website” means https://www.thedreamingheartartstudio.com.

​

"Email" means dreamingheartart@gmail.com.

2. THE SERVICE

 

2.1. A description of the Service is available on our website.  We will provide the Service with reasonable care and skill in accordance with the description set out on the website.

2.2. We reserve the right to vary or withdraw the Service described on the website without notice including but not limited to fee adjustments.

3. FEES, CANCELLATION, & RESCHEDULING
​

3.1 Once we have confirmed your party date, you will be sent a time-sensitive reservation link.  You are required to pay the base fee deposit via this link within 36 hours in order to secure your party date and time.  If payment is not made within this timeframe, you will forfeit the party date and it will become available to the public once more.

 

3.2 The base fee is *non-refundable. If you cancel the Service or if some/all of the participants do not attend your party you will not be refunded the base fee, neither in full nor partially. The base fee includes up to 6 participants and up to 1.5 hours of instruction/creative time for kid-focused parties and up to 2.5 hours of instruction/creative time for adult-focused parties.  If you have fewer than 6 participants, you are still required to pay the base fee.

*The only exception when it comes to refunding the base fee is if the Studio cancels your Service, in which case you will be refunded the base fee in full.

​

3.3 If you have more than 6 participants, additional participant fees will apply.  Cost varies depending on the type of art party (child-focused or adult-focused).  Additional Participant Fees will be due in full no later than the day the Service is provided, before the party begins. 

 

3.4 We require your total participant count a minimum of 10 days before your Service date.  This will ensure we are able to purchase adequate art materials. *Depending on Studio inventory, we can sometimes accommodate last-minute requests for additional participants.  Please don't hesitate to ask!

3.5 The Service is capped at 9 participants for in-Studio art parties.

​

3.6 If you need to reschedule your Service, please let us know a minimum of 14 days before your original Service date to avoid being charged a rescheduling fee.  Rescheduling requests made with less than 14 days' notice will be charged a *non-refundable $50 rescheduling fee + HST, due in full upon rescheduling.

4. IMPORTANT INFORMATION FOR IN-STUDIO ART PARTIES

​

4.1 Please note, for a child-focused in-studio art party, the hosting adult is welcome to remain in the Studio for the duration of the art activity to provide group supervision.  We ask that no more than two non-participating adults remain.  There is no additional cost for non-participating adults.  Alternatively, you are welcome to drop-off and pick-up the children; however, we require the parent of each participant fill out our Participant Enrolment Form prior to the party date so that we have important contact and medical information on hand.  If you select the drop-off/pick-up option, you will be sent a link to our Participant Enrolment Form via email, which we kindly ask that you forward to all parents.

 

4.2 We do not provide food nor drink.  You are welcome to bring NUT-FREE snacks and NON-ALCOHOLIC beverages to your party. Please bring your own plates, cups, cutlery, and napkins. Food and drink must be consumed during the allotted art party time.  The host is welcome to arrive 15-30 minutes before the art party start time to lay-out snacks.  Please DO NOT BRING CANDLES as we cannot have an open flame in the building.

5. IMPORTANT INFORMATION FOR OUT-OF-STUDIO ART PARTIES

 

5.1 Please note that for a child-focused out-of-studio art party, the adult who is hosting the party must remain on-site for the entire Service in order to provide supervision.  â€‹

5.2 The Studio does not provide tables or chairs.  You are responsible for providing and setting up tables and chairs ahead of time.  Please provide adequate table space for each participant to have a tabletop easel, a paint palette, brushes, a water cup, and a little elbow room.  The Studio does not provide protective table coverings for out-of-Studio art parties.  While the paint we use is typically washable on hard surfaces, it might permanently stain some surfaces. We highly recommend you protect your table(s) against stains and spills by using a disposable table covering(s).  â€‹

5.3 The venue must be made available to the Studio up to one hour prior to the Service start time and up to one hour after the Service end time, so as to enable the Studio to set up and take-down art materials.

5.4 Parties must take place indoors (unless previously agreed upon) with access to running water.

​

5.5 Travel fees may apply depending on your location.  Venues that are more than 30 km one-way (60 km total) from Rose's point of departure (home or studio) will incur a fee of $1.00/km for any mileage above and beyond the initial 60 km.

6. MISSING/LATE PARTICIPANTS
​

6.1 Rose will start instruction at the reserved time regardless of missing/late participants.  Rose will do her best to bring late-arriving participants up to speed, however, please note that instructions for said participants will be condensed so as to fulfill overall instructions for the group within the reserved time period.

7. CLOTHING

 

7.1 Please ensure participants wear art-friendly clothes as making art is messy and may result in permanent stains.  We do not provide smocks/aprons.

9. INDEMNITY CLAUSE

 

9.1 Neither the Studio, any of the art instructors, nor any of the assistants shall ever be held liable (jointly or severally) to you, the participants, or any of your respective estates or representatives, for personal injury or any incidental, indirect, or consequential damages of any kind, or any damages resulting from loss, whether or not advised of the possibility of damage, and on any theory of liability, arising out of or in connection with the Service.  Under no circumstance shall the total liability of the Studio, any of the art instructors, or any of the assistants for any damages or losses arising from the Service exceed the maximum amount of the price of the Service for which you paid.
